Cocoa Beach Reverses Ban On Residential Rentals Of Any Term

UPDATE: The City of Cocoa Beach announced that it is withdrawing the order and that the order was never in effect.

COCOA BEACH, Florida – The City of Cocoa Beach banned the rental of residential properties for any term where occupancy begins before June 30, 2020.

The City also banned the advertising of residential rental properties of any kind for the same duration.

The City imposed a $500 daily fine for anyone who advertises a residential rental property or rents a residential property in Cocoa Beach.

The fine can be levied against realtors advertising the property, the owners of the property, and the renters of the property.

Renters who use the lodging for occupational reasons such as space and defense workers, emergency personnel, governmental or health personnel, or infrastructure response, are exempt from the ban.

Brevard County previously banned hotels, motels, and campgrounds from booking guests for leisure and tourism purposes.

The City order places even more rental restrictions than Florida Governor Ron DeSantis’ Executive Order suspending vacation rentals to prevent people from fleeing coronavirus hot spots such as New York City that could increase the spread of the disease across the Sunshine State.

ORDER #14 PROHIBITING CHECK-INS FOR RESIDENTIAL RENTAL PROPERTIES FOR ANY TERM WITH EXCEPTIONS, AND PROHIBITING ADVERTISEMENTS OF RENTAL OF RESIDENTIAL PROPERTIES FOR CHECK-INS PRIOR TO JUNE 30, 2020

Beginning 5:00 p.m. 4/6/20 until rescinded

PURSUANT TO THE AUTHORITY vested in me as Cocoa Beach City Manager by the City Commission of the City of Cocoa Beach, in accordance with Amendment #1, City of Cocoa Beach, Florida, Declaration of Emergency Proclamation, approved March 19, 2020, (“Declaration”), I hereby Order that:

1) No check-ins for any residential rental properties for any term (whether long term or short term) shall be permitted unless the rental is to person(s) performing military, space program, emergency, governmental health or infrastructure response, and such person(s) shall provide written proof to the rental agent or owner and to the City of such military, space program, emergency, governmental, health or infrastructure response purpose of the stay. This prohibition does not include hotels and motels.

2) Advertisements for the rental of any kind of residential property, (including, but not limited to, condominium, cooperative, apartment, multifamily, duplex, or single family), for a residential property located in the City of Cocoa Beach for any term shall be prohibited for check-ins to take place prior to June 30, 2020. This prohibition does not include hotels and motels.

VIOLATIONS OF THIS ORDER are hereby declared to be violations under Cocoa Beach City Code Section 8.5-6 with fines for such violations set at $500.00 per day to be assessed individually against the owner of the property being rented, any rental agent involved, and against each and every person staying at the property rented in violation of this Order.
